1. Legal Notice & Compliance

Under the Medicines Act 1982, inhalation of cream chargers is illegal. We reserve the right to refuse or cancel any sale we suspect will breach this law. Possession of nitrous oxide for inhalation without prescription is an offence punishable by up to 3 months imprisonment or a fine of up to $500. You must provide accurate details (full name, date of birth, etc.) and valid Government ID at delivery. We may ask you the intended purpose of your purchase. Information may be disclosed to the Ministry of Health if requested. By ticking the box at checkout, you confirm you are purchasing for legal purposes only and consent to this data being collected and shared if necessary.

2. Product Safety

Always read the manufacturer’s instructions before use. Maximum chargers: 1 charger for a ¼ L or ½ L whipper; 2 chargers for a 1 L whipper. Overfilling may cause explosion. Chargers contain nitrous oxide under pressure: do not pierce with improper equipment; explosion/serious freeze burns may occur; do not expose to heat above 50°C or incinerate; never dispose of full chargers. Keep out of reach of children. Do not transport chargers by air — this is illegal.

3. Orders & Contract

Placing an order is an offer to purchase. No contract exists until we accept your order. You will first receive an acknowledgement email. A confirmation email will follow if we accept. If items are unavailable or pricing errors are discovered after acceptance, we may cancel or amend your order. If stock runs out, we may upgrade you to a premium brand (e.g., Whip-It! or ISI) at no extra cost. We may amend these terms at any time for future sales.

4. Prices & Payment

Prices are shown on our website at the time of order. If a pricing error is discovered within 14 days, we will notify you and give options to continue or cancel. Payment must be made in full before delivery (unless agreed business credit terms). No delivery will be made until cleared funds are received.

5. Delivery

Orders placed before 1:30 pm on a working day are processed the same day. Delivery times are estimates only (not guaranteed). Delays may occur during peak periods (e.g. Christmas, COVID-19). Goods are delivered to the address provided at checkout. If you deliberately fail to accept delivery, we may charge storage costs or resell the goods. All items are dispatched with authority to leave unless otherwise arranged. Insurance/signature options are available upon request.

6. Risk & Title

Risk passes to you upon delivery. Title remains with us until goods are paid in full. Business customers must store goods separately, keep them insured, and comply with insolvency provisions until full payment is made.

7. Returns & Refunds

7.1 Right to Cancel (Consumers)

You may cancel your order within 10 days of receiving the goods. Exclusions apply for consumables that cannot be returned once opened (unless faulty). Business customers are not entitled to cancellation rights.

7.2 Conditions for Returns

Written notice is required (post, hand delivery, or via our website “enotes” section). Phone cancellations are not accepted. Goods must be returned at your expense, unless they are faulty/misdescribed. Returned goods must be in good condition and securely packaged.

7.3 Refunds for Non-Faulty Goods

A 10% administration fee applies for cash refunds. If goods have been dispatched, postage and warehouse fees will be deducted. For local deliveries, the wage of the driver will also be deducted from the refund at a rate of $35 per hour, calculated from the starting point at Joseph Street, Salisbury East to the delivery location. The calculation is based on travel time shown on Google Maps at the time of the order. Refunds will be processed within 30 days of cancellation.

7.4 Faulty, Damaged, or Misdescribed Goods

Damaged in transit: notify us in writing within 7 working days (48 hours for business customers). Faulty/incomplete on arrival: notify us within 28 days. Warranty claims: new goods have a 12-month warranty, used goods have a 90-day warranty. Remedies may include repair, replacement, or full refund. Reasonable return postage will be reimbursed where fault lies with us.

8. Warranties

Warranties do not cover fair wear and tear, accidental or deliberate damage, negligence, misuse, or unauthorised repair. Any warranty claim must follow our returns procedure.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential losses (e.g., lost business, profits, or goodwill). Liability is limited to the price paid for the goods. Nothing excludes liability for death or personal injury caused by our negligence.

10. Data Protection

We take reasonable precautions to keep your order/payment details secure. Unless negligent, we are not liable for unauthorised access to data.

11. Governing Law

These terms are governed by Australian law. Disputes will be subject to the jurisdiction of Australian courts.

12. Vouchers & Promotions

Discounts/vouchers are subject to stated minimum order values (default: $10). Free items are subject to availability and may vary in brand.
